Case law concerning setting aside of arbitral awards under Dutch law
Ernste, P.E.
Schleijpen, C.L.
This collection contains a list of cases analysed for the contribution titled ‘Setting aside of arbitral awards: lessons for (NAI) arbitrators?’, chapter 23 of the book 'Arbitration in the Netherlands, in particular NAI Arbitration'. In this contribution, P.E. Ernste & C.L. Schleijpen discuss setting aside of arbitral awards under Dutch law and strive to provide more clarity on the dividing line between what leads to setting aside of an arbitral award and what does not. Part of the research for this contribution consisted of an analysis of published case law of Dutch courts concerning setting aside of arbitral awards. The goal of this analysis was to provide an idea of the types of situations in which arbitral awards are (or could be) set aside and the types of situations in which arbitral awards are not (or cannot be) set aside. The list of cases in this collection provides an overview of the cases examined. The results of the analysis are presented in the contribution.
